Stamp Duty and SDLT (Stamp Duty Land Tax)

Stamp Duty is not payable on the vast majority of all residential leases. For more detail see the LetLink Factsheet 32 which gives an admirable summary. It is no longer the case that tenancy agreements are no longer admissible as evidence in court unless they are stamped.

Obviously a tenancy agreement is just a lease, and leases are subject to SDLT (the replacement for Stamp Duty). The threshold for this however is £125,000, which is well above the value of the sorts of leases we deal with.
